Terms and Conditions for Picnow!

Welcome to Picnow!. These Terms and Conditions ("Terms") govern your access to and use of Picnow! (the “App”), operated by Damir Sušak (“we,” “us,” or “our”). By downloading, accessing, or using Picnow!, you agree to comply with these Terms.

If you do not agree with these Terms, please do not use the App.

1. About the App

Picnow! is a social media application that allows users to share images exclusively with one other user at a time.

2. Eligibility

You must be at least 18 years old to use Picnow!.
By using the App, you represent and warrant that you meet this age requirement.

3. Account Creation

To access certain features of the App, you must create an account using a valid email address.
You are responsible for maintaining the confidentiality of your account credentials and ensuring they are not shared with anyone.
You are fully responsible for all activities that occur under your account.

4. Subscriptions and Premium Features

The App offers optional in-app subscriptions for premium features (e.g., no upload limitations).
Subscription payments are managed through RevenueCat.
You agree to the applicable fees and payment terms displayed when purchasing premium features.

Refund Policy: All payments are final and non-refundable unless required by applicable law.

5. User-Generated Content

You may upload images to share with one other user.
All shared content is automatically deleted after it is sent to the receiving user at the end of the day.

Ownership: You retain ownership of the content you share; however, by using Picnow!, you grant us a limited, non-exclusive, royalty-free license to process, transmit and delete your content solely for the App's functionality.

6. User Responsibilities

By using Picnow!, you agree to:

  • Not upload, share, or distribute content that:
    • Is offensive, violent, pornographic, sexually explicit, or promotes illegal activity.
    • Infringes on any third-party intellectual property or privacy rights.
    • Constitutes spam, harassment, or abuse.
  • Not attempt to manipulate, hack, or disrupt the App's operation or security.

We reserve the right to suspend or terminate your account if you violate these rules.

7. Third-Party Services

The App integrates third-party services, including RevenueCat for subscription management. Your use of such services may be subject to their separate terms and conditions.

We are not responsible for the practices of third-party services.

8. Termination

We may suspend or terminate your access to the App at any time if:

  • You violate these Terms.
  • We are required to do so by law.

Upon termination, your account and all associated content will be deleted.

9. Disclaimers

The App is provided on an “as-is” and “as-available” basis. We do not guarantee that the App will always be uninterrupted, error-free, or secure.
You use the App at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, or consequential damages arising from:

  • Your use of the App.
  • Content shared on the App.
  • Interactions with other users.

11. Governing Law

These Terms are governed by the laws of Germany, without regard to conflict of law principles.
